Disclosures & Disclaimers
1. Ownership and brand
Virtaire is a product and trademark of Emergent Intelligence Group LLC, a Texas limited liability company (“EIG”), c/o Corporate Service Center, Inc., 15500 Voss Rd, Ste 425, Sugar Land, Texas 77498, United States. All references to “the studio,” “we” or “us” on the Site refer to EIG. Virtaire is not a licensed real estate brokerage, appraiser, inspector, surveyor or photographer, and does not provide real estate, legal, appraisal or inspection services.
2. AI-generated content disclosure
Virtaire videos are produced with generative artificial intelligence. Depending on the package you choose, AI is used to:
- recognize rooms and generate captions from your photos;
- generate camera motion and simulated depth-of-field from still images (“AI animation,” “simulated focus”);
- digitally add furnishings and decor to rooms (“virtual staging,” “furniture arrival”);
- generate a custom music track from a text brief (optional).
What this means: the moving image you see was synthesized from a still photograph. It is not newly filmed footage, drone footage, a walkthrough recording, a 3D scan or a measured tour. AI models can and do introduce errors — changed textures, reflections, lighting, fixtures, hardware, artwork, plants, window placement, views, wall colors and small architectural details; elements that appear or disappear between frames; and close-up detail that does not exist in the source. Our prompts instruct the models to preserve existing features and forbid adding people, but preservation is a constraint we request, not a result we guarantee. Pan + zoom films apply camera motion only and make no generative change to the image itself; they are still not filmed footage.
3. On-screen disclosures embedded in every Film
Every Film carries permanent, non-removable disclosures rendered into the video itself: a compact badge on each shot (for example “Virtually staged · AI animation,” “AI-generated animation,” “Source-image animation,” “Source-image animation · Simulated focus,” or “Supplied media · AI effects may be present”) and a three-line closing disclosure card. Depending on the order, the closing card states one of the following technique lines together with a source line and an illustrative-media line:
- “VIRTUAL STAGING + AI MOTION: furnishings digitally added; visual errors may occur.”
- “AI-GENERATED MOTION: visual errors may occur; not newly filmed footage.”
- “PAN + ZOOM: source-image animation; not newly filmed footage.”
- “AI FURNITURE ARRIVAL: furnishings and their textures are digitally generated.”
- “SUPPLIED CLIPS: AI effects or virtual staging may be present; visual errors may occur.”
- “Source: supplied listing imagery. Verify features and condition against the property.” / “Source: frames extracted from a supplied video, not original photographs.”
- “Compare supplied footage, furnishings, fixed features and condition with the property.” (supplied-clip orders)
- “Illustrative marketing media; not a measured survey or condition guarantee.”
- “AI close-ups + shallow focus: detail may be inaccurate; blur can obscure context.” (AI packages with detail close-ups)
- “Detail close-ups: source crops + simulated background blur; context may be obscured.” (pan + zoom with detail close-ups)
- “Illustrative staging animation; not newly filmed footage. Visual errors may occur.” / “Staged-detail focus is simulated; other details use source crops.” (furniture-arrival orders)
- “Soundtrack: AI-generated.” or “Music: AI-generated.” (custom-song orders)
- “External media and soundtrack provenance require studio review before publication.” (supplied-clip orders)
Single photo animations carry the badge “AI photo animation · Verify property details.” Cropping, covering, trimming or editing out these disclosures violates the Terms and may make your advertising misleading.
4. Virtual staging disclosure
Where virtual staging or furniture-arrival animation is used, the furniture, rugs, lighting, art, plants, textiles and decor shown are not included with the property and do not exist in the room. Virtual staging is limited to movable furnishings and decor; Virtaire will not remove existing furniture, clutter, damage or fixtures, and you may only request furniture-arrival animation for rooms that are actually empty in the source photo. Furnishing textures, colors, scale and placement are illustrative and may be rendered imperfectly.
5. Property condition, features and accuracy disclaimer
Nothing in a Film is a representation, warranty or guarantee by EIG — or by the agent or brokerage using the Film — of the property’s condition, dimensions, square footage, layout, finishes, fixtures, views, lot, boundaries, location or compliance with any code. Simulated focus and background blur can obscure context. On AI packages, detail close-ups are AI-generated shots and may show fine detail that does not exist in the property; on pan + zoom films, close-ups are crops of the source photo and cannot recover detail the original photo did not contain. Neither demonstrates condition. Films are illustrative marketing media only. Buyers, sellers and their representatives must verify all information independently through in-person viewing, disclosures, inspections, surveys and public records.
6. Source imagery and rights
Films are created from photographs supplied by the ordering customer or retrieved from a public listing page the customer designated, or from frames extracted from a listing video the customer supplied. The customer represents that they hold the rights to that imagery. EIG does not verify photo ownership, MLS license terms or photographer agreements, does not bypass logins or bot protections to obtain images, and is not responsible for imagery a customer was not entitled to use. Photos may incidentally include people, belongings or documents; we do not detect or remove them.
7. Real estate advertising, MLS and regulatory disclosure
- Verify destination rules before publishing. MLSs, listing portals, video platforms and brokerages set their own requirements for virtually staged or altered images — including labeling each staged photo, watermarking altered real-property images, displaying the unaltered original alongside, and restricting contact information in media intended for MLS. A Film’s generic footer disclosure does not satisfy photo-specific requirements.
- Texas: licensees must follow TREC advertising rules, including 22 TAC §535.155 (misleading advertising; broker identification). HAR MLS rules governing virtual staging, altered photographs and media contact details apply to Houston-area listings. Rules change; check the current text.
- No-contact (“MLS”) edition: our no-contact edition omits the agent contact card, but you remain responsible for confirming it meets your MLS’s media rules, including any requirement for a broker name or for staging labels on individual media items.
- Fair housing: all advertising must comply with the federal Fair Housing Act and state and local law. Do not use staging, captions or song briefs to suggest a preference for or against any protected class.
- Virtaire does not certify compliance of any Film with any MLS, regulator, platform or brokerage policy. A human quality review of a Film is a production check, not a legal or compliance opinion.
8. Music disclosure
Listing films include a licensed background track (“Boardroom Undercurrent”) unless you order a custom song. Custom songs are generated by a third-party AI music model from your text brief and are disclosed on the closing card as “Soundtrack: AI-generated.” or “Music: AI-generated.” Music is licensed for use only as embedded in your Film. Single photo animations are silent. Platforms such as YouTube, Instagram and TikTok apply their own audio policies; we do not guarantee that any track will pass a platform’s content-identification system.
9. Example videos on the Site
Example films and artwork on the Site are demonstrations. Marketing artwork labeled “AI-generated decor illustration” does not depict any real property. Example listing films were produced from imagery supplied to the studio and carry the same embedded disclosures as customer Films; they illustrate the product and are not offers to sell, representations about the properties shown, or evidence that any property is currently listed. Those examples are shown with written consent from the listing agent or owner.
10. Third-party AI and service providers
Generation is performed through third-party AI services (currently xAI for image and video generation and room recognition, and ElevenLabs for custom music), on infrastructure provided by Cloudflare and rendering hosts such as Railway, with payments by Stripe. Provider availability, rate limits, spending allowances and model behavior are outside our control and may delay or pause production. Provider names are used for identification only; no endorsement is implied.
11. Availability
No turnaround time is guaranteed. Orders are processed sequentially and each listing film receives a human quality check before release. We may pause ordering, and features and turnaround may change.
12. No professional advice; no guarantee of results
Nothing on the Site is legal, brokerage, marketing-compliance or financial advice. We make no promise that a Film will attract buyers, shorten days on market, increase sale price or perform on any platform. Results depend on factors outside our control.
13. Security statement
We implement and test security controls appropriate to a small studio — private authenticated downloads, hashed credentials, encrypted provider keys, signed payment webhooks and rate limiting. These are not a security certification or audit attestation. See the Privacy Notice for details.
